1. These Terms of Service (the "Agreement") are entered into by and between the subscriber ("you", "your" or "Subscriber") WaveComm LLC and or its affiliates (WaveComm", "us" or "we"). The Agreement sets forth the terms and conditions under which you agree to use the Service, and under which WaveComm agrees to provide the Service to you. This Agreement is made up of the terms below, plus the Acceptable Use Policy all Attachments to this Agreement, and the other policies and materials specifically referred to in these Terms of Service, all of which are incorporated herein by reference.
2. AUTHORIZED USER, USE, AND RESPONSIBILITIES.
You acknowledge that you are 18 years of age or older, and you agree that you have the legal authority to enter into this Agreement and affirm that the information you supply to us is correct and complete. You understand that WaveComm relies on the information you supply and that providing false or incorrect information may result in Service provisioning or delivery delays or the suspension or termination of your Service. You agree to promptly notify WaveComm whenever your personal or billing information changes (including for example, your name, address, telephone number, and credit card number and expiration date).
You agree that you are responsible for all use on your account, including any secondary accounts or sub-accounts registered to your primary account. You understand this means that you accept full liability and responsibility for the actions of anyone who uses the Service via your account, or any secondary accounts, with or without your permission.
3. CREDITS AND REFUND OF SERVICES.
No Credit or Refunds for Prepaid Service. We offer a 30-day money back guarantee during that time any problems should be reported to WaveComm. If you choose not to use the service this will not entitle you to a credit, or refund of payment(s) made to WaveComm.
4. ILLEGAL USE.
The service that WaveComm provides to you can only be used for lawful purposes. Transmission, or storage of any material in direct or indirect violation of any local, state or federal laws or statute such as invasion of privacy, slander or harassment is prohibited. This also includes material protected by copyright, trade mark, or any other property right used without proper authorization, and all material that is obscene, constitutes an illegal threat, violates export control laws, makes fraudulent offers, sells, or service. The service that WaveComm provides to you will not be utilized in any way to produce, transport or receive, possess, or distribute Child Pornography or any material that may endanger children, as defined in the sole discretion of WaveComm and/or the appropriate legal authorities of competent jurisdiction.
5. SYSTEM AND NETWORK SECURITY
Violation of system or network security is prohibited and may result in criminal and civil liability. WaveComm’s system or network security violations include, without limitation, the following:
Unauthorized monitoring of data and/or traffic on any network or system without authorization of the owner of the system or network.
Unauthorized access/use of data, systems, and network, including any attempt to scan or test the vulnerability of a system without the authorization of the owner of the system or network.
Use of services in a manner that obstructs the processor, bandwidth or other system or network resources so as to interfere with or degrade services to any other user, host, or network including:
Falsifying user information provided to WaveComm or to other Service users.
Mailbombing, denial of service attacks, installation of “auto-responders”, or similar automated or manual routines, transmission of worms, virus and other malicious codes, port or network scanning, flooding, or deliberate attempts to overload a system or broadcast attacks.
Attempts to use the service in such a manner so as to avoid incurring charge for/or otherwise being required to pay for such usage or using a personal account for high volume or commercial use.
Engaging in any of the activities prohibited in the policy by using another provider’s services but channeling the activity through a WaveComm account.
Revealing any account password or other information related to the service or allowing use of your service by authorized agents.
6. DISCLAIMER OF WARRANTIES AND LIABILITY
WaveComm is not responsible for any damage that may be caused to your computer system or for loss of data that resulted from any materials downloaded from our broadband services. Applicable taxes apply. Speed and uninterrupted use of the services are not guaranteed. This agreement is subject to change without prior notice.
